General Terms and Conditions for the Aramis Trading GmbH Shop Platform (October 2022)
1. Scope of the General Terms and Conditions of Aramis Trading GmbH
Aramis Trading GmbH provides all deliveries and services on the basis of these GTC (General Terms and Conditions) in the version valid at the time of ordering. These GTC apply for an indefinite period unless they are modified by a written agreement between the parties. Otherwise, the provisions of the Swiss Code of Obligations regarding purchase contracts and other relevant Swiss laws apply.

2. Offer and Conclusion of Contract
Catalogs and publications on the internet are generally non-binding. By clicking the “Order” button in the online shop, the customer places a binding order. Aramis Trading GmbH confirms receipt of the order immediately upon receiving it. If, after the order has been placed, it is determined that delivery of the goods is not possible or that there was a pricing error, the customer will be contacted. In the event of price errors, the customer is entitled to return the goods to Aramis Trading GmbH. In any case, the customer cannot assert any further claims against Aramis Trading GmbH or a supplier.
The information in the sales documents (drawings, illustrations, dimensions, weights, and other services) is to be understood only as guidelines and does not constitute an assurance of properties, unless they are explicitly designated in writing as binding.

3. Prices
The prices stated in the order confirmation are decisive. For B2B transactions, the prices are in Swiss francs excluding statutory VAT, whereas for B2C transactions, the prices include statutory VAT. The current prices are published in the online shop; price changes and errors are reserved.

4. Delivery Conditions
Delivery
Goods weighing up to 30 kg will be delivered via DHL to any postal address in Switzerland and in the Principality of Liechtenstein. For items over 30 kg, delivery is made by freight carrier to the nearest accessible curbside. The costs can be found in the price list.
Available items are typically delivered within 2 to 4 working days. Items marked “On Order” are not available from Swiss stock; the delivery time will be checked and communicated.
Dates and delivery periods are non-binding unless expressly agreed otherwise in writing. Any specified delivery periods and dates stated by Aramis Trading GmbH are subject to correct and timely delivery to Aramis Trading GmbH by its suppliers and manufacturers.
For deliveries including assembly, the customer must ensure access for the goods.
Visible quantity discrepancies, complaints regarding damage, loss, or poor packaging must be reported to Aramis Trading GmbH immediately upon receipt of the shipment. Hidden quantity discrepancies must be reported in writing within 4 days of receiving the goods.
Pickup on Site
The goods can usually be picked up within 2 to 4 working days after scheduling an appointment.

5. Fulfillment of the Contract
If the customer, after the expiration of a grace period set for him, refuses to accept the goods or declares that he does not wish to accept them, Aramis Trading GmbH may refuse to fulfill the contract and claim damages for non-fulfillment.
Risk passes to the customer as soon as the shipment is handed over to the transport company responsible for delivery. Any agreement in individual cases that Aramis Trading GmbH will assume shipping costs does not affect the transfer of risk.

6. Payment
- **B2B:** Payment is made by invoice.
- **B2C:** For online orders, payment is made in advance, by credit card, or via Twint. All payments are processed through Six Payment Services. The data is encrypted and transmitted to Six Payment Services for processing.
If a service (assembly, service delivery, etc.) is booked through the Aramis Trading GmbH online shop, the service contract is concluded between the customer and the third-party provider. Aramis Trading GmbH assumes no liability in this regard.

7. Retention of Title
The goods remain the property of Aramis Trading GmbH until full payment has been made.

8. Warranty & Guarantee
Aramis Trading GmbH and/or the supplier/manufacturer provide a two-year guarantee from the date of delivery or pickup for the product’s freedom from defects and proper functioning, unless explicitly agreed otherwise in writing.
If the manufacturer’s operating or maintenance instructions are not followed, changes are made, parts are replaced, or consumables are used that do not meet the original specifications, any warranty/guarantee shall lapse to the extent that the defect is attributable to these actions. This also applies if the defect is due to improper use, storage, or handling of the devices, external intervention, or the opening of the devices.
Minor deviations from the warranted characteristics of the goods do not trigger any warranty or guarantee rights. Liability for normal wear and tear, as well as for consumables and accessories, is excluded.
In the event of a warranty or guarantee claim, Aramis Trading GmbH or the manufacturer will choose the method of rectifying the defect. The warranty period is not interrupted by a warranty or guarantee claim; it continues to run.

9. Returns
Goods delivered will generally be taken back (only after prior agreement with Aramis Trading GmbH), provided they are in a hygienically flawless condition. The goods must be returned within 10 days of receipt in unused condition and in undamaged original packaging, including the invoice number and reason for return, at the buyer’s expense.
If the customer can prove defects in the delivered goods, the defects will be remedied or the goods replaced within a reasonable period. If this is not possible, the customer is entitled to a refund or a reduction in the purchase price. The costs of return shipment are borne by the customer.
The customer is in all cases responsible for packaging the goods to be returned in a way that is suitable for transport. Any damage to the goods due to improper packaging will be charged to the customer. When the customer hands over the goods to a transport company, the customer bears the risk for the safe transport of the goods. The transfer of risk to Aramis Trading GmbH occurs only upon receipt of the goods by Aramis Trading GmbH.

10. Limitation of Liability
Claims for damages due to impossibility of performance, breach of contract, fault in concluding the contract, or tortious acts are excluded both against Aramis Trading GmbH and its agents and substitutes, unless there is intentional or grossly negligent conduct. Any liability for consequential damage resulting from the use of the products is excluded.

11. Security and Data Protection
Data necessary for handling transactions is stored. All personal data is, of course, treated confidentially. There is a reservation to use the data for verification of its correctness. Credit card data is also encrypted and not stored by Aramis Trading. Each transaction is authorized and checked online by the respective credit card companies. Blocked or incorrect cards cannot be used.

12. Final Provisions / Place of Jurisdiction
The place of jurisdiction is the registered office of Aramis Trading GmbH, 7310 Bad Ragaz, Switzerland. Swiss law applies exclusively.
The parties will endeavor to resolve any disputes arising from the implementation of this agreement amicably.
By placing an order, the customer accepts these general terms and conditions. Any changes or additions to the general terms and conditions are made solely by us and must be in writing.
Aramis Trading GmbH reserves the right to change these general terms and conditions at any time.
